Today it was the turn of Apple Computer to fights its side of the battle, rejecting claims by Apple Corps Ltd. that selling music via the iTunes Music Store was a violation of an agreement made in 1991.
Apple Computer lawyer Anthony Grabiner said that "distribution of digital entertainment content" was permitted under the agreement made in 1991. he went on to say "even a moron in a hurry" could distinguish between a computer company selling music and a record label.
"Data transmission is within our field of use. That's what (the agreement) says and it is inescapable" said Grabiner.
